Breaking the Deadlock in Your Insurance Dispute
If you and your insurance company agree that a loss is covered, but cannot agree on the dollar amount of the damage, you don’t have to settle for their low-ball estimate. Most Florida property policies include an Appraisal Clause—a powerful alternative dispute resolution process that avoids the time and expense of a lawsuit.
At Azeem & Associates, we act as your professional Appraiser, providing the technical expertise and local market knowledge necessary to secure a fair and accurate valuation of your claim.
How the Appraisal Process Works
When you "demand appraisal," the process typically follows these steps:
-
Selection of Appraisers: You hire an independent appraiser (Azeem & Associates), and the insurance company hires their own.
-
Choosing an Umpire: The two appraisers select a neutral third party, known as an Umpire, to act as the tie-breaker if they cannot agree.
-
Detailed Valuation: We conduct a thorough inspection, gathering evidence, repair estimates, and material costs to build a comprehensive "Scope of Loss."
-
Negotiation & Award: We meet with the insurance company's appraiser to reach an agreement. Once two of the three parties (the two appraisers or one appraiser and the umpire) sign the Appraisal Award, the decision is binding on both you and the insurance company.
Why Choose Azeem & Associates as Your Appraiser?
The appraisal process is highly technical and requires an advocate who understands Florida’s specific construction costs and building codes.
-
Accuracy in Estimating: We use industry-standard software (Xactimate) combined with local South Florida labor rates to ensure every shingle and drywall sheet is accounted for.
-
Negotiation Tenacity: We don’t just submit a number; we defend it. We have years of experience standing up to carrier-hired appraisers to protect our clients' interests.
-
Florida Keys & Coastal Experts: We specialize in the high costs of coastal construction and the unique requirements of island-based property repairs.
Is Appraisal Right for Your Claim?
Appraisal is often the fastest way to resolve a dispute regarding:
-
Difference in repair vs. replacement costs.
-
Disputes over the quality of materials needed (e.g., matching tiles or high-end cabinetry).
-
Differences in the square footage or quantity of damaged items.
Appraisal vs. Litigation: Which Path is Right for You?
When you hit a standstill with your insurance carrier, you generally have two paths to resolve the dispute. While Azeem & Associates can assist in both scenarios, understanding the difference is key to a faster recovery.
Feature
Insurance Appraisal
Litigation (Lawsuit)
Primary Goal
To settle a dispute over the dollar amount of the loss.
To settle a dispute over coverage (denials) or legal breaches.
Speed
Fast. Usually resolved in weeks or a few months.
Slow. Can take 1–3 years to reach a trial or settlement.
Process
Handled by independent appraisers and a neutral umpire.
Handled by attorneys, judges, and potentially a jury.
Cost
Generally lower; you pay for your appraiser and half the umpire.
Generally higher; involves attorney fees, filing fees, and court costs.
Binding?
Yes. Once an "Award" is signed, it is legally binding.
Yes. A court judgment or signed settlement is final.
When to Choose Appraisal
Choose the appraisal process if your insurance company admits the damage is covered but is offering an amount that is too low to complete the repairs. It is the most efficient way to get the extra funds needed for high-quality materials and local labor rates.
When to Choose Litigation
Litigation is typically necessary if the insurance company denies your claim entirely, claiming the damage was caused by something not covered (like "wear and tear"), or if they have acted in "bad faith."
